1. Data Protection

3. Promotional discount codes

3.1 From time to time, we may offer promotional discount codes that may apply to any or some specific purchases made through this Site.

5. Terms of Sale

5.1 By placing an order, the customer undertakes to purchase the product under and in accordance with the following conditions.

5.2 All orders are subject to availability and confirmation of the order price.

5.3 Additionally, under distance selling regulations, the customer may return any item (except tights and underwear) within 28 days of collection for a refund or direct exchange to another size/color of the same product.

5.4 Orders returned after 28 days will not be accepted and will be returned to the customer.

6. Sales contract with the customer

6.1 The sales contract between the company and the customer is concluded when confirmation is sent by e-mail that the ordered goods have been sent to the customer.

7. Payment

7.1 Once we receive your order, we will perform a standard pre-authorization check on your payment card to ensure that your payment card has sufficient funds to complete the transaction.

7.2 The order will not be shipped until the initial authorization is completed. The card will be charged once the order is accepted.

7.3 All credit and debit card transactions are processed securely.

7.4 We tokenize and never store customer card information, which provides a secure environment for making purchases on our website knowing that the data entered is secure.

7.5 SSL technology enables the encryption of potentially sensitive information such as name, address and other sensitive information such as credit card details (during the tokenization process).

8. Liability

8.1 Nomadic State of Mind – Supplier – will make every reasonable effort to ensure that the Goods are as described, of satisfactory quality and fit for purpose.

8.2 If the Company does not make such reasonable efforts, Buyer will notify Nomadic State of Mind in writing within 7 days of delivery and it will be the Company’s sole responsibility to repair, replace or deliver the Goods.

8.3 Nothing in the Regulations may be construed to limit or exclude the Supplier’s liability for death or personal injury resulting from the negligence of the Supplier or its employees or agents.

9. Intellectual Property

9.1 All Intellectual Property Rights in the Goods, unless already acquired, are the exclusive property of Nomadic State of Mind.

9.2 Buyer will not register any intellectual property rights or claim such rights in the Goods and will retain all information about Supplier’s rights in the Goods and will notify Supplier if it discovers any infringement of such Supplier’s rights by a third party.

9.3 The Buyer acknowledges that due to the purchase of the Goods or otherwise, he does not acquire a right or license to produce the Goods.
